The term general criminal law means conventional criminal law. Theft, fraud, embezzlement, maltreatment, sex offences and violations of the traffic legislation are examples of general offences. The criminal law team at CMS Derks Star Busmann has extensive experience with acting in these types of criminal proceedings.
If you or your company have/has been a victim of an offence like those outlined above – i.e. harm by an employee perpetrating fraud – we will tend to the criminal report and then, during the criminal proceedings, will recover the damage from the offender. When doing so, we work closely with experts in civil law who are based at our office.
If you are personally suspected of committing an offence, working with you we will try to prevent you from becoming involved in legal proceedings. But if it nevertheless comes to that stage, we will professionally act for you during all phases of the proceedings. This is, of course, at the Law Courts and during the appeal at the Court of Appeal. But we also have the required special expertise in-house for the special proceedings at the Supreme Court. Dian Brouwer, Head of our Criminal Law practice group, is the Chairman of the Association of Supreme Court Lawyers in Criminal Cases.
